The District Court from Chandigarh Sector-43 Court Complex has acquitted Anil Kumar, a resident of Raipur Khurd, who was arrested in the case of rape of a 17-year-old minor. The court gave this decision on the basis of the statements of witnesses, the victim turning hostile and the DNA profile not being found from the fetus in the CFSL report. During the hearing, when the victim was produced in the court, she clearly said that she does not know Anil Kumar and has never seen him. She admitted that she herself had made up a false story in front of the doctor and counselor and took Anil’s name.
The CFSL report made it clear that no DNA profile could be confirmed from the fetus removed from the victim’s womb. This could not prove who was the father of the fetus. This report continued to weaken the arguments of the prosecution.
This was the case
On December 30, 2022, the Moulijagran police station received information from Sector-16 Hospital that a 17-year-old minor was admitted in a pregnant condition. WCHL in the hospital. In the presence of the counsellor, the victim had told that she was in a relationship with a young man named Anil, who is a friend of her brother.
She had said that both of them wanted to get married and had consensual physical relations twice. After confirming the pregnancy, she wanted to have an abortion. She had also told the counsellor that she did not want to file any complaint against Anil, as she wanted to marry him.
This is how the case was registered
On the basis of the report of WCHL, Moulijagran police had registered a case under section 376 (2) (N) of the Indian Penal Code on January 1, 2023 and arrested Anil Kumar. The police had also recorded the statement of the victim before the magistrate under 164 CrPC.
