The Punjab and Haryana High Court has given an important verdict in favor of the employees of Nagar Parishad, Jind under the principle of equal pay for equal work. The court, while directing to give the same salary to the Nagar Parishad employees as the employees of the state government, made it clear that the amount of difference in salary should be given to the employees by the concerned authority within three months.

Know what is the matter?

This case is related to those employees who were initially appointed by the Nagar Parishad, Jind and later sent on deputation under the state government. These employees had claimed in their petition that they should be given the same salary as the employees of the state government.

The petitioners argued that despite doing the same work as the employees of the state government, they were not being given equal salary. The court accepted this demand and issued an order to give the employees of the Nagar Parishad the same salary as the employees of the state government.

Earlier, this case was heard

Earlier, in the Ram Chander vs State of Haryana case, the division bench of the High Court had made it clear that the effective date of the revised pay scale to be given to the employees of the Municipal Council would be January 1, 1994, and not April 1, 1999.

During the petition, the state government argued that the difference in salary (differential amount) should be paid by the Municipal Council, as the employees were initially appointed by the Municipal Council.

At the same time, the Municipal Council claimed that the employees had received salary from the state government during deputation, so this amount should be given by the state government.

Order to make payment within 3 months

After hearing the arguments of both the parties, the division bench of Justice Jagmohan Bansal said that there is no dispute about the rights of the petitioners. The court directed that the authority / department which had paid the salary during the relevant period will pay the amount of difference in salary.

The court also clarified that no interest will be charged on this amount. The order said that the concerned authority should ensure payment of this amount within three months. This decision of the High Court can also provide great relief to employees of similar status working in other departments.
