Ferozepur resident Narinder Kaur told the High Court that on 11 September 2016, she had joined a government school as an ETT teacher. After this, on 8 March 2017, she had an accident due to which she became 90 percent disabled.
The Punjab-Haryana High Court, while giving an important order, made it clear that if an employee becomes disabled during the service period and is not able to work, then also the government will have to pay salary and further pension till his retirement.
While filing the petition, Ferozepur resident Narinder Kaur told the High Court that on 11 September 2016, she had joined a government school as an ETT teacher. After this, on 8 March 2017, she had an accident due to which she became 90 percent disabled. The condition of the petitioner is such that she cannot even sign. The financial condition of the petitioner has deteriorated and in such a situation, the government should be ordered to release her full salary.
The District Education Officer wrote a letter to the Director of Education Department informing him about the condition of the petitioner and requested him to consider his case for releasing the salary. It was told that he went to the house of the petitioner and saw his condition which was very bad. The petitioner was not even able to use his hands and feet. Despite this letter, the case of the petitioner was not considered.
The High Court found that the petitioner’s signature is not there on the petition, only his thumb impression is present. The High Court said that the government cannot leave the employee at the mercy of God in this way. The High Court has now ordered the Punjab Government to pay the petitioner salary till his lifetime or till retirement. Also, if the petitioner retires, then in that case he should be given the benefit of pension. Meanwhile, whenever his junior gets promoted, the petitioner should also be given the benefit.
