In the kidnapping case in Chandigarh District Court, the victim girl retracted her statements, after which the court acquitted the accused Aryan due to lack of evidence. The victim said in her statements that Aryan did not kidnap her, she had gone to her friend’s house.
While the victim’s mother had lodged a complaint in Police Station-31, in which she had said that Aryan had kidnapped her daughter. Aryan remained in jail for 6 months after the case was registered.
At the same time, Aryan’s lawyer Himanshu Rajpal said that the complaint given by the mother to the police was false, because the girl whom Aryan was accused of kidnapping, retracted her statements and also refused to undergo medical examination.
He said that it was alleged that Aryan took the girl to a hotel and did wrong to her, but this too could not be proved. Constable Sunil, who was made a witness of the incident, also did not reach the court to testify.
FIR lodged on 11 February 2022
A woman lodged a complaint with the Chandigarh Sector 31 police station that her minor daughter was lured away by a boy. The police took action and registered a case under section 363 (kidnapping) of the IPC on 11 February 2022.
In the complaint given to the police, the victim’s mother told that she works in an IT company in Zirakpur. On February 10, at around 2:30 pm, her daughter left the house without telling anyone. When she returned from work in the evening, her mother told that the girl had left the house in the afternoon.
Initial investigations suspected the girl’s kidnapping. The team of investigating officer ASI Balbir Singh recorded the statements of witnesses and prepared a map of the spot during the investigation of the case.
Girl recovered from the park
The police wrote in the FIR that on February 12, the police took action and recovered the minor girl from a park located in Sector-44. She was in the custody of Aryan, a youth of village Burail, Sector 45, Chandigarh.
After identification, the accused was arrested from the spot and the girl was taken to GMCH-32 hospital for medical examination under the supervision of investigating officer Kulwinder Kaur. However, during the medical examination, the victim refused to undergo internal examination.
After which the girl was admitted to Mahila Bal Suraksha Grih, Sector 24. During the investigation, the accused Aryan was sent to jail after medical examination. After this, the police said that investigation revealed that the accused had taken the girl to a hotel in Sector-45. On this basis, Section 366 (kidnapping and taking away with intent to marry or have physical relations) was also added to the case.
