The District Consumer Disputes Redressal Commission has held Behrooz Biryani guilty of negligence in service and imposed a fine of Rs 2500 on it. The commission has also directed to return the amount of Rs 356 paid by the complainant for the biryani along with 9 percent interest. The commission said in its decision that the accused party said in its reply that they had offered a refund to the complainant, which itself shows an admission on their part that the food was unhygienic to eat. Therefore, the accused party is liable to return the amount paid by the complainant for the food ordered.
Opposing the complaint filed, Behrooz Biryani said that the orders are prepared as per standard operating procedures while following the highest standards of food hygiene. Vegetarian and non-vegetarian products are kept completely separate. The photographs provided by the complainant are prone to tampering and pre-planning and hence cannot be considered as evidence at all. In the case, the commission said that one thing is clear from the arguments and evidence that the accused party delivered food items to the complainant, which contained dead insects, which caused mental agony and illness to the complainant. Which is a deficiency in service on the part of the accused party. As far as relief is concerned, as in the bill of Rs 415, the complainant paid Rs 356 for biryani and Rs 59 for gulab jamun. Therefore, after deducting the amount paid for gulab jamun, the complainant is entitled to get Rs 356 for biryani.

Abhinav Kaundal, a resident of Sector-42C, had filed a complaint in the District Consumer Disputes Redressal Commission alleging negligence in service against Behrooz Biryani and Bengaluru-based Bundle Technologies Private Limited. The petitioner stated in the complaint that on the evening of September 10, 2023, he had ordered home delivery of delicious Paneer Dum Biryani and Gulab Jamun from Behrouz Biryani’s outlet in Sector-22, Chandigarh through Swiggy application and paid Rs 45. On investigation, it was found that the said food item contained dead insects, but in the meantime, the complainant’s health deteriorated due to eating a small quantity of the said food item. After this, the complainant immediately tried to contact the respondent’s executive through the Swiggy application. After this, the complainant lodged a complaint with the accused party and demanded a refund of the amount paid.
