The reply of Haryana Staff Selection Commission (HSSC) in the ongoing case regarding a contempt petition in the Punjab and Haryana High Court has given great relief to the unemployed youth. In fact, a contempt petition has been filed in the High Court against the Chairman of the Commission, Himmat Singh, for not recruiting the pending posts of Group C by HSSC and not fully implementing the decision of the High Court dated 31 May 2024.
During the ongoing hearing in this petition, a reply has been filed by the Commission, in which it has been claimed that in four weeks, recruitment will be done to fill the posts of the remaining 5 groups of Group C. Commission Chairman Himmat Singh has filed this reply in the High Court. Which has been taken on record.
Recruitment will be done for these five groups
The High Court will now hear this matter on 25 February. Petitioner’s advocate Chandrahas Yadav said that petitioner Shubhendra has said in the petition that the respondents (Chairman Himmat Singh) have recruited on some groups, but recruitment has not been started on group numbers 12, 13, 22, 30 and 32 and no advertisement has been issued for it. This shows deliberate disregard of the High Court order.

1. HSSC has written in its reply to the High Court that the court order has been complied with, under which the revised result has been released on 3 July 2024.
2. The High Court had said in the decision that the candidates who have already been appointed as per the results of 5 February 2024 and 11 March 2024 will also participate in the fresh advertisement and only meritorious candidates can continue in the fresh selection.
In this regard, it is submitted that out of the youth whose names were recommended by the Commission, about 38 review applications are pending before the Division Bench and are listed for hearing on 21 February, therefore the Commission is unable to comply with this order of 31 May 2024.
3. Some candidates have filed contempt petitions. Another is pending for 25 February. During the hearing on the contempt petition, the Chief Secretary of Haryana has given information about the steps taken to comply with the instructions on these two points by giving an affidavit.
In addition, on 21 January this court has passed this interim order, the advocate of the respondents has submitted on the instructions of the Chief Secretary’s Office of Haryana that the order of this court dated 31 May 2024 will be fully complied with in four weeks. Therefore, it is urged that this contempt petition be dismissed in the interest of justice.
These 2 major allegations have been made in the petition
1. Deliberate contempt
The petition filed in the High Court states that it is prayed that the record of the case be summoned and contempt of court proceedings be initiated against the respondent for deliberate disobedience of the order dated 31st May 2024 passed by the High Court in the present case, as the respondent has complied with the decision on a pick and choose basis and has thereby partially violated the order. Therefore, it is contempt.
2. Demand to issue arrest warrant
In the interest of justice, the respondent in the present case deserves to be punished for this. It is also prayed that the respondent be punished for his malicious act, arrest warrant against the respondent and attachment of the properties of the respondent be issued and he be charged for committing the offence of contempt of the High Court.
