Helper grade one employees of Haryana Power Generation Corporation, who were regularized by the order of the High Court, have got a big relief from the High Court. They will get 6 percent interest on arrears from the date of the High Court’s order to regularize them.
The High Court has ordered the corporation to release this amount within three months. Sat Narayan and others had filed a petition in the Punjab-Haryana High Court demanding their regularization.
The High Court ordered to regularize the date of appointment
The High Court had ordered to regularize them from the date of their appointment, 5 September 1991. Along with this, it was directed to release arrears and other benefits to them. Haryana Power Generation Corporation went to the division bench in appeal against the order of the single bench.
The appeal is still pending with the division bench, but the division bench did not stay the order of the single bench. Meanwhile, the petitioners filed a contempt petition. While the contempt petition was pending, Haryana Power Generation Corporation complied with the order of the single bench.
Order to release 6 percent interest on arrears within three months
The petitioners once again approached the High Court and said that they did not get interest on arrears. The High Court found that there was no stay order in the appeal and Haryana Power Generation Corporation had to comply with the order within 2 months.
Despite there being no stay, the High Court held Haryana Power Generation Corporation bound to pay interest from two months after the order was issued for not complying with the order. The High Court has now ordered Haryana Power Generation Corporation to release 6 percent interest on arrears within three months. However, the court made it clear that this amount will depend on the decision coming on the appeal before the division bench of Haryana Power Generation Corporation.
