Thousands of Punjabi Youths in Canada Face Potential Repatriation! Notice Issued
Following the implementation of new immigration laws in Canada, thousands of Punjabi youths residing there are facing mounting difficulties. After the passing of the new Bill C-12, Canada’s Department of Immigration has issued notices to approximately 30,000 individuals who had been living in the country as asylum seekers after their work permits had expired. Among these individuals, an estimated 9,000 are reported to be Punjabi students and workers, who now face the looming threat of deportation proceedings. This measure has been taken to curb the misuse of the system and to ensure that asylum is granted only to those with genuine needs. In protest against this decision, students from various countries—including Punjabi students—staged demonstrations in Winnipeg, demanding relief from the government. The protesters argue that the abrupt change in regulations has jeopardized the future of thousands of young people.

The new immigration regulations introduced by the Canadian government are deemed effective as of 2025. As a result of this change, foreign nationals who were already residing and working in Canada have also fallen under the purview of this legislation. This group includes a significant number of Punjabi students who, after completing their studies, had begun working in the country either on the basis of a work permit or by seeking asylum.

Following the introduction of these new rules, the status of these students has become uncertain. Concerns regarding their future have intensified due to the tightening of asylum-related procedures. In protest against this situation, Indian students have been continuously staging demonstrations across various cities, demanding that the government provide them with relief. The students assert that the sudden alteration of regulations has put both their careers and their hard work at risk.

It is worth noting that the asylum seekers who have received these notices will be granted an opportunity to demonstrate their eligibility under the new legislation. Recipients are required to submit their response within 21 days from the date specified on the notice. Furthermore, they are advised to consult with an immigration lawyer before formulating their response. Under this new regulation, individuals are required to file their application for asylum within one year of their arrival in Canada. If an application is submitted more than a year after arrival, it will be deemed ineligible. In cases of delayed applications, relief under the law will be granted only to those refugees who can demonstrate a compelling reason for the delay and provide proof thereof. If such proof cannot be furnished, the applicant will have a 90-day window during which they may seek legal assistance through a lawyer. Meanwhile, spouses who hold Permanent Residency (PR) status or a valid visa are eligible to apply for PR themselves. Subsequently, you will have the option of undergoing a Pre-Removal Risk Assessment, under which the government will verify the validity of the compelling reasons you have cited. For instance, if you claim that your life would be in danger upon being returned to India, this claim will be thoroughly investigated before any further action is taken.

Furthermore, refugees who have been issued a removal notice will retain the opportunity to return to Canada in the future, provided they voluntarily depart the country upon receiving the notice. However, if they are forcibly deported, they may face a permanent ban on re-entering Canada. According to the Canadian Department of Immigration, approximately 30 percent—or about 9,000 individuals—of the 30,000 people currently in this situation are Punjabi youth. These individuals are currently working in Canada on temporary visas or under refugee status.

Canada’s Minister of Immigration, Marc Miller, has clarified the government’s stance regarding the new immigration laws. He stated that these changes have been implemented with the objective of making Canada’s immigration system more transparent and effective. According to the government, refugee status will now be granted exclusively to individuals who are genuinely affected by circumstances such as war, violence, or severe persecution.

The government has explicitly clarified that an individual will not be recognized as a refugee solely on the grounds of having been denied Permanent Residency (PR) or a visa. Officials note that citizens from various countries—including India, Mexico, and Nigeria—are currently residing in Canada illegally due to non-compliance with visa regulations; consequently, this measure was deemed necessary to curb such unauthorized residency.

Immigration experts believe that, in light of this stricter enforcement by the government, the avenue for remaining in Canada by claiming refugee status has effectively been closed. Under the new law, time limits and eligibility criteria will be strictly enforced, which could directly impact thousands of foreign nationals.
