The Sessions Court in Panchkula has upheld the lower court’s decision holding a government school teacher guilty of assaulting a student. However, the court has ordered her release on six months’ probation.
According to the information, this case is of 30 December 2021. Bharti Verma, Principal of a government school located in Parwala, had complained to the police that Sector-8 resident teacher Kirti Malik (39) beat up a class 6 student just for touching her car. The complaint also alleged that Malik behaved abusively and threateningly with the principal, villagers and school staff.
The student was medically examined, in which pain in his left ear, redness in the throat and scratches on the index finger of the left hand were found. On this basis, a case was registered against Malik at Raipur Rani police station under Section 323 (voluntarily causing hurt) and Section 506 (criminal intimidation) of the Indian Penal Code. The trial court had sentenced her to 2 months simple imprisonment and a fine of ₹500 on 21 August 2023.
Kirti Malik had filed an appeal against this decision. The Sessions Court found the allegations against her to be correct on the basis of medical reports and the testimony of the victim. However, considering that Malik has been facing trial since March 2022, she has no criminal record and the student had suffered minor injuries, the court ordered her release on six months’ probation.
The court directed that Malik submit a personal bond of Rs 25,000 and a surety and maintain peace and morality during this period. Violation of the order will result in punishment. Also, the court directed to pay Rs 10,000 as compensation to the student.
