Pending cases in courts in Haryana will be put on hold: New litigation policy ready, meeting on 27th, every department will have a nodal officer with law background

In view of the increasing number of pending cases in the courts of Haryana, the government is going to bring a litigation policy. Its draft is almost ready. Under the policy, nodal officers with legal background will be appointed in every department.

This appointment will be done at the state and district level. Through this policy, the rights of the people of the state will be protected and the government will create an effective and responsible grievance redressal mechanism. Through this new policy, all those departments which are in the public sector will be connected to it. Under this policy, the responsibility of all the departments associated with it will be decided.

Meeting called on May 27

A meeting has been called on May 27 to finalize the litigation policy. In this meeting, the draft of the policy will be finalized. This meeting will be chaired by Chief Secretary Anurag Rastogi. Under the litigation policy, the work of settling cases in a timely manner will be done in any department.

To implement this policy, the government includes Chief Secretary Office, AG Office, Law and Legislative Department, Home Department, Head of Public Sector Department, Law Officer, Department of Prosecution.

Three layer proposal made

The proposal to implement this policy is three-layered. State Level Empowered Committee, Department Level Empowered Committee, District Level Committee have been included. These committees will monitor the legal cases falling in their jurisdiction. The District Level Empowered Committee will submit its report every month.

The District Level Committee will be headed by DC. The Department Empowered Committee will be formed under the chairmanship of the Administrative Secretary. The State Level Empowered Committee will be formed under the chairmanship of the Chief Secretary. The Advocate General Office will also be involved in this committee.

Action will have to be initiated on complaints within 7 days

It has been proposed in this policy that all departments will form complaint redressal committees. So that unnecessary legal cases can be avoided. The committee will also ensure that people’s complaints are dealt with seriously.

So that the government does not face any legal problems in future. These committees will be formed within 14 days after the notification of the policy. Action will be initiated on any complaint received by the committee within seven days. Along with this, the committee will send all the recommendations related to the case to the higher authorities within 30 days.

The committees will also ensure that all the pending cases in the departments are brought to the Lok Adalat and resolved.

1. This will be the qualification of the nodal officer

Every department of the government will have a senior administrative officer with law background and specialist, who will be nominated as the nodal officer under this policy. The nodal officer will be appointed at the state level and district level.

He will be responsible for active management of court cases and continuous monitoring of court case proceedings and will ensure that there is no delay from the department’s side in handling cases in various courts.

2. These will be the work of the nodal officer..

– Will consider each writ or notice and respond to the employee or the general public. Apart from this, legal notices, petitions, letters from the AG office will be sent to the concerned nodal officer, who will be responsible for bringing it to the attention of the concerned administrative secretaries, department heads.

– After this, approval can be issued to file appeal, writ petition, civil revision, regular second appeal, settlement case or any other case on behalf of the state government for further necessary action.

– This will enable direct interaction with the law office and legislative, administrative secretaries to avoid procedural delays. On receiving orders from the courts, he will ensure that all the papers are sent to the concerned officials promptly for filing the reply.

– Apart from this, he will tell the time limit within which action is to be taken and in case of no action, he will raise the matter before the concerned officials.

– The nodal officer will review the cases every 15 days. These will include filing replies and working on the orders and directions of the court as well as filing LPA, SLP, RSA, FAO, RFA and CR.
